Finding the right lawyer for your need can be difficult, especially if you don’t know who to look for.
The estate planning attorney is an incredibly important individual in your life, so it’s essential that he or she understands your needs, goals and dreams. It’s also important to consider who your lawyer belongs to: they are not just clients; they are members of a community too. If you don’t trust his experience or his knowledge, he won’t be able to help you with any problems that come up later on. Estate planning lawyer is such a broad topic that I think it’s best to start with a list of the most important concepts one should include in their estate planning. Having said that, I’m not completely sure how helpful it is to talk about these in a preface.
The best way to learn what you should be discussing is by talking about it. When you do so, you gain insight on what you should be discussing and can use this information as an anchor for your discussion. The most important notion for anyone who is thinking about planning for their estate is that there are two different types of estate planning: traditional versus what I call “futurist” or “fiat” estate planning. Traditional Estate Planning A traditional estate plan allows the owner at least some control over the disposition of his or her assets after death. The plan will usually specify: the beneficiary(s) to whom the assets will go; where the assets are going; and when they are going to die (e.g., when they will be distributed). It may also allow the trustee or other executor to pay certain benefits to beneficiaries on behalf of the owner, such as alimony or general living expenses (such as rent). In addition, it may require that certain property be disposed of in certain ways. For example, if substantial improvements have been made on real property and if those improvements have not passed down through the family line, then any transfer of ownership will require approval from local authorities before transferring title. This all sounds good but does it mean anything? Well yes and no. It does mean something if you want control over how your assets are distributed after your death and it does mean something if you want control over which beneficiaries receive what amounts and when (you can only do one at a time), but in each case there are exceptions to this rule – like real property being donated by a parent and rent being paid for on behalf of two tenants sharing a home – so just because there aren’t any specific rules doesn’t mean much (it probably means nothing at all). If you’re looking hard enough you might find examples of these exceptions in court documents, but this isn’t always going to be enough information if you need help drafting an estate plan yourself.
The value of an estate planning attorney is not a one-size-fits-all proposition. In the example above, when a client needs a financial advisor for their estate planning attorney, that advisor is someone who understands the client’s goals, values, and vision.
In other words, each client’s unique situation calls for a unique approach — and this is where the power of an estate planning attorney comes in. An experienced attorney may be able to offer a more accurate and personalized plan than another attorney with whom they are working with; but even if that isn’t the case, each client’s unique situation calls for a unique approach. So when you need an estate planning attorney — don’t just use any lawyer! Use someone who knows your goals, wants to understand you better and makes sure you are getting what you need from them. That’s what every good lawyer does — get to know their clients well enough to provide great advice on how to achieve specific goals in specific situations.
The estate planning attorney is the best resource for estate planning. You need to be able to see yourself in a global context. You need to understand what other people do, and have the best chance of keeping your assets out of the wrong hands.
A good estate planning attorney will know what your goals are, which will help you set realistic expectations and give you the tools you need to achieve them.
